Portrait Studio Policies & Terms Of Service
Please electronically sign for these policies below. This agreement must be signed and submitted before any session can begin.
Payment Arrangement
The Client will pay the Photographer the total fee specified in the invoice they receive from Chelsey Grant Photography. The total fee will include the amount specified in the invoice as well as mileage and lodging as specified below.
For photography sessions beyond 20 miles of zip code 85297, the Client is responsible to pay mileage for the excess amount (roundtrip), as well as for additional time spent driving to and from the session.
The total fee presented on Chelsey Grant Photography’s invoice to the Client is payable at the time of the specified session unless otherwise outlined below:
Due to the custom nature of the work, payment for your order must be placed in full before the session takes place. Payments may be made cash, check, Visa, MasterCard, or American Express.
Due to the downloadable nature of this content, once digital files are delivered, the sale is final and non-refundable. Digital files cannot be released until full payment is made.
Lodging: In the event that lodging is necessary in order to complete the agreed-upon photo session, the Client agrees to pay no less than $100.00 to the Photographer at the time of the session.
Copyright
The Photographer retains the entire copyright at all times for the photographs taken during the specified session. Where a digital file of photographs has been provided to the Client as a part of their personal collection, these photographs may be printed and displayed at home and on-line, for personal but not commercial use.
The Photographer retains the right in all cases to use the photographs obtained under this agreement in any manner at any time for the purpose of advertising or otherwise and maintains ownership of the original digital file.
The Copyright Act protects photographers by giving us the exclusive right to reproduce your photographs. Violations include, but are not limited to, making illegal copies, scanning, printing from home, or downloading from our website. It is illegal to copy, edit, alter or reproduce these photographs in any manner without our permission, and violators of this Federal Law will be subject to its civil and criminal penalties. Please understand, the photographer wishes to maintain complete control over the print quality, finishes, and presentation of the images and any reproduction outside of the studio may lower the quality of the image and scar our reputation for providing superior portraits.
As an artist, Chelsey Grant Photography requests that the work she creates be allowed into art exhibits, displayed in her studio, print competitions, social media platforms, printed materials, and other places that her work is featured regularly. The work is always showcased in the best possible way and will never compromise or jeopardize the photographer’s reputation or that of her clients. Confidentiality in advertising is always maintained.
Image Size, Color, Style & Composition
All image sizes are approximate. The Photographer will provide a pleasing color balance but cannot guarantee an exact color match to the environment the photograph is taken in. It is sometimes not possible to record in print the exact color as seen by the human eye. There is no right to reject photographs on the basis of style or composition.
Re-touching will be performed to the artist’s desired outcome and is considered the final version. Artist will not perform any re-touching she does not see as fit for the image. The artist will adjust for lighting, color correction, and personal touches to skin and other aspects of the image, however, there will not be extensive editing available to change body parts or head swaps, for example.
While Chelsey does capture many images during your session, you will see only those images selected by her, the artist, for previewing. She carefully renders each image to ensure maximum artistry and technical excellence. Images with eyes closed, heads turned, duplicates, etc. will not be shown and are removed from our archives permanently after the artist’s rendering is complete.
Please allow up to 4 weeks for your order to be completed. Some orders may take longer. Your portraits are an investment and an heirloom that should not be rushed. All ordered images are kept on file for a period of 1 year.
Attendance
In the unlikely event that the Photographer is unable to complete the coverage due to unforeseen circumstances, the Photographer reserves the right to reschedule. The Photographer shall notify the Client at the time of the unlikely event of any rescheduling.
If the Client is unable to attend the session as outlined, to unforeseen circumstances he/she is responsible to notify the Photographer and reschedule a session.
It is important to be punctual, the session will begin at the agreed start time.
Indemnity
The Photographer agrees to indemnify and hold harmless the Client against all expenses, damages, claims, and legal costs arising out of any failure by the Photographer to obtain any clearances for which she was responsible in respect of third party copyright works, trademarks, designs, or other intellectual property. The Photographer shall only be responsible for obtaining such clearances if this has been expressly agreed upon before the day of the session. In all other cases, the Client shall be responsible for obtaining such clearances and will indemnify the Photographer against all expenses, damages, claims, and legal costs arising out of any failure to obtain such clearances.
Location Costs
The Photographer will not guarantee or arrange payment on any location. Some National Parks or various locations may require parking or entrance fees that are not covered by the Photographer.
Liability
The Photographer is not responsible for any injuries inflicted upon any participating parties. The client will be responsible for themselves and their children and releases the Photographer from any claims against their person or their business.
